Sample termination letter to employee for poor performance, misconduct, job abandonment

We regret to inform your termination from service with immediate effect i.e. 23rd Feb’14 from ABC and Co., from the post of Junior Executive (Operations). This is due to the repeated complaints of:

• Poor performance – work quality not up to the mark
• Job abandonment – frequent breaks, exceeding breaks and gossip in office hours
• Misconduct during working hours – using abusive language within office premises

You have already been sanctioned warning letters thrice, duly signed by yourself, for each of the complaint listed above. Your signed letter is the documented proof of your acceptance of repeated misconducts, without improvement in performance and abandonment of your responsibilities. You also had personal meeting with your team manager and human resource executive following the warning letters, with your verbal assurances for rectifying your mistakes.

As you didn’t follow your assurances, and repeated use of abusive language and violence within the office, has forced the management to take this extreme step. As per the terms of the final warning letter sanctioned to yourself dated 20th Dec’13, you are asked to leave with immediate effect.

Your full and final settlement will be completed by our human resource team within 7 days of your termination date that is latest by 1st Mar’14. To raise an objection, you can contact Human Resource executives within 3 days that is latest by 25th Feb’14.

We regret to inform you that this letter serves as your official termination from PQR and Co. from the post of Junior Executive (Sales) with effect from 22nd March, 2014. Since you compromised with the company’s work policies, we cannot allow you to continue working with us.

You have been terminated on the basis of poor performance, misconduct and job abandonment. Poor performance in the form of failing to achieve the set targets repeatedly, and according to your supervisor, you did not put in the required efforts. Your huge misconduct when you arrived drunk at office. You also abandoned your job by taking excessive breaks and wasting precious time by gossiping.

You were repeatedly warned against such behaviour and issued warning letters which you had duly signed accepting your poor performance, misconduct and abandonment of your job. You also personally met with your team member and the Human Resource executive and assured them that you would discontinue your bad behaviour and work harder.

However, we haven’t seen any improvement in your performance and in fact you seem to be getting bad to worse each day. You did not stay true to your word, forcing us to take this drastic step. The management asks you to leave with immediate effect. Also regrettably, we find it difficult to recommend you to a new employer.

You are required to contact Human Resource Executives within three days of receipt of this letter for any objections. Despite your shaky start at PQR, we really hope you would realize your folly and be able to make a new beginning career wise.
