Sample legal letter for Employee leaving without notice

It has been observed that your resignation letter does not mention anything about your notice period. As per the terms of your appointment letter you are required to serve a complete one month notice period effective from the date of resignation. In case, you do not serve the notice period, you have to pay the organization a complete one month’s salary.

Since, you neither paid the required amount nor have you been serving the notice period, the organization shall be initiating a legal action against you. To avoid the same, you may visit the Director of the institute tomorrow at 11.00 am and settle the terms with him. You may be required to serve 30 day notice period or pay one month’s salary to the organization as decided by the Director. Your absence tomorrow shall confirm your non co-operation in the matter and may cause a legal action against you.

As of now, your resignation remains unaccepted.

  • What if I need to leave without noticce because of the emotional and mental abuse where i get no positive feedback. That all I do there is not right. I am part time and they take advantage of me by call ins and working a week and a half straight or even more without time off or i request time off which is leading to stress and health crumbling as well as my home life with two kids involved crumbling

Your sudden disappearance from work is an act of unprofessionalism which is not entertained in our company. If you are leaving job, you must apply for a resignation prior to 1 month from the date of leaving. This was mentioned in the contact letter signed by you on the day of joining.

It is entirely at your will to leave or continue with the job. We do not restrict our employees from looking for further opportunities of their choice but we are very strict about the rules and regulations extended before you once you are a part of our company.

Your sudden disappearance from work is extremely amateurish. Our executives tried to reach you over phone, but you seem to ignore their phone call continually which makes it very evident that you have left the job without a prior notice.

There were pending works and assignments that needed your attendance and your sudden absence has been a drawback to the team and caused them additional efforts. You are asked to report in the office within 2 days from today else legal action shall be taken for the same the basis of the contract signed by you.
